On refiling an EB-1A application

Here’s a post by immigration lawyer Amber Davis on refiling an EB-1A application:

Got denied for an EB-1A?

Consider a refile.

In my practice, I get refiled cases (many which are not originally my cases) approved all the time. It’s not an abnormal practice to refile, especially if your profile for EB-1A has evolved to better fit three of the criteria.

That’s not to say that refiles always work. Sometimes, you need to present the facts in a different light or make a new case based on additional evidence.

If you think you have a strong shot, I’d say go for it but just make sure your profile has really changed since your last filing (something you can discuss with a qualified immigration lawyer).
