EB-2 NIW as an alternative to PERM

Here’s a post by immigration lawyer Amber Davis on finding alternatives to PERM:

For a lot of you out there who are hoping to go through the PERM process, you may want to start looking into other ways to secure a priority date.

With layoffs still going on and the threat of further layoffs at the end of the year, many companies are still pausing their PERM programs or may not restart their programs in 2025 as planned.

With the EB-2 NIW, you’ll be able to secure a priority date possibly much earlier than you would be able to through PERM given the current PERM backlog, which can definitely help when the time comes for you to adjust status (especially if you are Rest of World).

An earlier priority date secured through EB-2 NIW can also be applied to a later EB-1A (something to consider if you’re an Indian or Chinese national).
