Keeping your EB-2 NIW I-140 and changing jobs

Here’s a post by immigration lawyer Amber Davis on keeping your EB-2 NIW I-140 and changing jobs:

With an approved self-filed EB-2 NIW, you can keep your I-140 even if you change jobs (or experience a layoff).

Because with EB-2 NIW, you’re your own petitioner.

With PERM, you will not be able to keep your I-140 if you leave the employer that got you the I-140.

With an employer-sponsored EB-2 NIW, your employer is the petitioner and has ownership of the I-140. Some people might be successful still using the I-140 even after leaving their employer, but this is uncertain, and in many cases impossible.

Something to keep in mind, especially given the number of layoffs that are still happening.
