Layoffs and EB-2 NIW for Rest of World nationals
Here’s a post by immigration lawyer Amber Davis on how layoffs might lead to more EB-2 NIW applications from Rest of World nationals:
5 years ago, I didn’t do that many EB-2 NIWs for Rest of World nationals. I did PERM. PERM was actually better than NIW.
I mostly handled EB-2 NIWs for Indian and Chinese nationals.
WIth the current state of PERM processing times and ongoing layoffs in big tech, things are no longer the same.
Now, I’ve been seeing a lot more Rest of World nationals who have been unable to get a priority date through PERM because of layoffs (either they got laid off and now have to restart PERM at their new job or their company has paused PERM because they’re laying people off) applying for EB-2 NIW.
WIth no end to layoffs in sight for a lot of big companies, I wouldn’t be surprised if we started to see EB-2 NIW applicants as well as EB-1A applicants from countries outside of the usual top 5.
