EB-2 NIW and Teaching USCIS the Law

Sometimes, the only way to get an application approved is to teach the law to USCIS.

Not in a condescending manner, but more so “here’s our interpretation and reasons for why it’s the correct interpretation.”

USCIS has become far more reasonable in recent months, especially with NIWs.

They are willing to listen (well, some officers at least) and for say NIW, where the law can be unclear, a strong legal argument can sway things in your direction.

At least that’s what I’ve noticed in the NIW cases I’ve worked on.
