You can apply for both EB-1A and EB-2 NIW at the same time
Here’s a post by immigration lawyer Amber Davis on applying for both EB-1A and EB-2 NIW at the same time:
It’s possible to file both EB-1A and EB-2 NIW at the same time.
It’s not something I usually recommend to clients, however, unless they need a green card as soon as possible and do not currently have a priority date (in which case I tend to recommend EB-1A if they already have a strong case in addition to EB-2 NIW). I don’t recommend it because it’s a lot of money and the benefits are slight, not huge. But it can be the best option if you want to ensure every possible door is being opened in the most timely manner.
USCIS will look at both applications independently so applying for both will not affect your chances for either.
